<p><strong>Location of offices and where duties will be performed</strong></p>

<p>This should be set out in detail - not just the country but also the location of the offices and geographical area that the expat activities will cover. Will they be expected to travel to other countries in the course of this assignment? If so, how often and what is the likely duration of such trips?</p>

<p><strong>Duration of assignment</strong></p>

<p>Whether the expatriate is unaccompanied or relocating with their family, a firm idea of the contract period, the duration of the assignment must be specified. If this is to be determined by the completion of a specified objective, an estimated duration will need to be given. The contract should also specify whether there is a trial period and, if so, how long that period lasts and how it is evaluated.</p>

<p><strong>The job function</strong></p>

<p>Les actifs des épargnants des contrats d’assurance-vie sont obligatoirement déposés auprès de différentes banques dépositaires.</p>

<p>Ces actifs sont isolés des fonds propres de la Compagnie et font l’objet d’une convention tripartite établie entre le Commissariat aux Assurances, la compagnie et la banque dépositaire.</p>

<p>Ce cadre permet aux épargnants de bénéficier d’un effet de levier sécuritaire quand à leur dépôts.</p>

<p>En France, la situation est bien différente. Les actifs des contrat d’assurance-vie sont fondus dans la compagnie d’assurance et en cas de défaillance, vous n’êtes qu’un créancier chirographaire et vous ne bénéficiez d’aucun privilège.</p>

<p>La loi du 6 décembre 1991- Art 37 stipule que les actifs mobiliers doivent être déposés auprès d’un établissement agréé par le Commissariat aux conditions fixées par le règlement grand-duché du Luxembourg. Les titres de la dette publique luxembourgeoise, les obligations de communes et d’établissements publics ainsi que les obligations de sociétés luxembourgeoises garanties par l’Etat sont admis pour leur valeur nominale. Les autres actifs représentatifs sont admis pour la valeur à fixer par le Commissariat. Les entreprises doivent tenir l’inventaire permanent des actifs représentatifs de chaque gestion distincte et en communiquer au Commissariat la situation trimestrielle dans les formes et délais fixés par le Commissariat.</p>

<p>L’article 39 et 40 de la même loi décide que le souscripteur d’un contrat luxembourgeois est un créancier super privilégié de premier rang en cas de défaillance de l’assureur.</p>

<p>« En cas de faillite de la compagnie d’assurances, les actifs de cette dernière seraient affectés en priorité à la couverture des engagements d’assurance. Un privilège de l’Etat lui-même viendrait en second rang en ce qui concerne les actifs représentatifs ».</p>
